Buildings higher than six stories are required to have an inspection done every five years according to New York City Local Law 11. A Qualified Exterior Wall Inspector (QEWI) is sent by the city to conduct the inspection, after which he files a report on the condition of the building’s exterior. If the facade needs repairs, those repairs must be completed within 90 days of the report. Otherwise, the building owner will face penalties and heavy fines.
When a QEWI does their inspection, they classify your facade into one of three categories.
1. Safe: The facade is considered safe and needs no repairs at this time.
2. Safe With a Repair & Maintenance Program (SWARMP): The facade is safe but does need some repairs.
3. Unsafe: The facade’s condition poses a danger to the public and repairs are necessary in order to make it safe again. If your building is determined to be unsafe, you are required to add temporary protection immediately, such as a fence or some other way of blocking or marking off the unsafe area. After you have your building repaired, you have two weeks to file another report on the status of your facade’s safety. If your repairs and subsequent report can’t be completed within 104 days, you will need to file for an extension in order to avoid penalties.
